In the Divorce Court, yesterday morning, Mr. Justice Butt and a common jury had before them the case of Gyte v. Gyte and Mullineaux, a petition by the husband, Bartholomew Gyte, manager of some cotton mills at Langcliffe, near Settle, in Yorkshire, for a dissolution of his marriage with his wife, Sarah Ann Gyte on the grounds of adultery with the co-respondent, Mullineaux, in business as a general dealer at Whittlebrook, near Manchester; and against him there was a claim for damages. There was no defence. The parties were married on the 15th July, 1854, and afterwards cohabitated together at Langcliffe. Their married life was happy until the end of last year, It appeared the respondent went to Southport in August, 1883, to improve her health, and there made the acquaintance of the co-respondent, to whom she stated that she was unmarried. By the wifes invitation, the co-respondent with two of his children visited petitioners house last January, Mr. Gyte having at that time no suspicion of anything wrong. On the 20th of April last she was absent a night from home, and the next day informed her husband that she had misconducted herself with a man, and recommended her husband to take proceedings for a divorce. The petitioner accordingly caused inquiries to be instituted, and then learnt that on the night of the 20th April she and the co-respondent slept as man and wife at the Joiners Arms, at Austwick, a place adjacent to the petitioners house. Petitioner was examined, and in cross-examination said that during the 30 years of his married life he had never quarreled with the respondent. Further evidence establishing the adultery having been given, counsel for the respondent addressed the jury in mitigation of damages. The judge, in summing up, said it was for the jury to show by their verdict, if they found for the petitioner, what estimate they formed of the value of a wife whose relations with her husband up to the end of last year had been unbroken by strife. The case was certainly one of exceptional matrimonial felicity. The jury, after a short consultation, gave a verdict for the petitioner with £500 damages, which amount was certified for and a decree nisi pronounced.
